Maybee of the Town of Belleville, County of Hastings, District of Victoria and Province of aforesaid, of the other part purporting to be a Deed of Bargain or Sale, whereby the said Cornelius Vanwicklin for in and consideration of the price of one hundred and fifty pounds of Lawful money of Canada, hath granted, bargained, sold, aliened, transferred, conveyed and confirmed unto the said John W. Maybee, his heirs and assigns forever, all and singular, his tract or parcel of land situated in the Township of Cramahe, it being part of Lot Number Two in the Eight concession of the township of Cramahe which said lot or parcel of Land is butted and bounded as follows this is today commencing at the south east angle of said lot thence north sixteen degrees, west sixty five chains to the road now traveled to the River Trent intersecting the road leading from Brighton to Percy thence west along the said road twenty chains more or less to Percy and Brighton road thence south sixteen degrees east sixty five chains more or less to the eighth concession line, thence east along the said concession line twenty chains more or less to the place of beginning containing by admeasurement one hundred and twenty acres more or less. Together with all Houses, Out-houses, Woods and Waters thereon erected, lying and being, and all and singular the hereditaments and appurtenances to the said premises in anywise belonging: to have and to hold the same unto the said John W. Maybee, his heirs and assigns, to the sole and proper use, benefit and behoof of the said John W. Maybee, his heirs and assigns forever. (Portion referring to Cornelius wife, Anne, is lined through suggesting she was deceased or otherwise legally separated from him by 1842. Note that she is mentioned in the 1840 deed of sale.) And which said indenture of Bargain and Sale is witnessed by William Coulson of the Township of Cramahe, yeoman, and Alfred Moyhn of the Town of Bellville, merchant, and this memorial thereof is hereby required to be registered by me the said John W. Maybee the grantee therein named, as witness my hand and seal, this twenty third day of April in the year of our Lord One Thousand Eight Hundred and Forty Five. B) " In the Surrogate Court of the County of Hastings In the Goods of John Way Maybee deceased I, Thomas Ward of the Town of Sarnia in the County of Lambton, Sherriff's Bailiff, make oath and say; 1) That I did on the twenty fifth day of March in the year of our Lord one thousand eight hundred and seventy, personally served Elizabeth Mowbray with a true copy of the hereunto annexed citation by delivering and leaving the said copy with the said Elizabeth Mowbray at her residence in the Township of Sombra. 2) That I necessarily traveled nineteen miles to make such service.

To Martha Maybee, widow and Julianne Coleman, wife of Abel Coleman, both of the village of Colborne, Allen T Maybee of the Town of Belleville, and Alfred Maybee of the Village of Warkworth, John W Maybee of South Haven, in the State of Michigan in the United States of America and Elizabeth Mowbray of the Township of Sombra in the County of Lambton and all or any of the next of kin of said John Way Maybee deceased.
Whereas Albert Lewis Smith of the Town of Belleville in the County of Hastings Esquire, a creditor of said deceased by petition to said Court set forth that the said deceased died at Belleville in said County Intestate, that he is a creditor of said deceased by virtue of a certain judgement resolved in her Majesty's Court of Queens Bench at Toronto wherein one John O'Hare now deceased was plaintiff and one Alfred Maybee and the said deceased were defendants for the sum of one hundred and twelve pounds eleven shillings and six pence damages and costs, and said petitioner is desirous of obtaining limited administration of the personal estate and effects of said deceased that he may be able to realize the amount of the said judgement out of the real estate of the said deceased.
You are hereby cited to come before the Surrogate Court of the County of Hastings and administer to the personal estate and effects of said deceased, or that you appear before the Honorable George Sherwood, Judge of said Court at his chambers n the Court House in Belleville on Monday the twenty fifth day of April AD1870 at ten o'clock in the fore noon to see and examine the proceedings and show cause if any you have why the administration of the personal estate and effects, rights and credits of the said deceased should not be granted to the said Albert Lewis Smith.
